Terms and Conditions of Sale

2. Acceptance of Terms  
By accessing this website and/or placing an order through the Shopify checkout system, the  
customer confirms having read, understood, and fully accepted these Terms and Conditions  
of Sale without reservation.  
These Terms apply to all orders placed through the BelgianMart Shopify store.  
3. Products and Availability  
Products are described and presented as accurately as possible.  
However, slight variations may occur, including but not limited to labels, packaging, or  
production year.  
In the event a product becomes unavailable after an order has been placed, BelgianMart will  
contact the customer and offer one of the following options:  
● shipment of an equivalent product,  
● a full refund, or  
● delayed shipment or pre-order.  
4. Sale of Alcohol – Legal Age Requirement  
In accordance with Belgian law, the sale of alcoholic beverages is strictly prohibited to  
persons under 18 years of age.  
By placing an order on the Shopify checkout, the customer confirms being legally entitled to  
purchase alcohol.  
BelgianMart reserves the right to request age verification at checkout, prior to shipment, or  
upon delivery.  
If age verification is refused or fraudulent information is suspected, the order will be  
cancelled.  
Shipping fees will not be refunded.  
5. Prices and Taxes  
All prices displayed on the Shopify store are in USD.  
For orders shipped within the European Union, prices include VAT, unless otherwise stated.  
For orders shipped outside the European Union, VAT does not apply. Import duties,  
customs charges, or administrative fees imposed by the destination country remain the sole  
responsibility of the customer, unless such charges are clearly indicated and included at  
the time of checkout.  
6. Orders and Payment  
Payment is due in full at the time of order placement via the Shopify checkout.  
Accepted payment methods may include, depending on availability:  
● Credit and debit cards (Visa, Mastercard)  
● Bancontact  
● Other payment methods supported by Shopify  
Orders will only be processed and shipped once payment has been successfully received  
and confirmed.  
7. Shipping and Delivery  
Shipping costs are calculated and displayed at checkout before payment confirmation.  
Delivery times provided are estimates only and may vary due to carrier operations, customs  
processing, or external factors beyond BelgianMart’s control. No compensation may be  
claimed for delivery delays.  
Transfer of Risk  
For consumer customers, the risk of loss or damage transfers to the customer only upon  
physical receipt of the goods, in accordance with applicable European consumer  
protection laws.  
Damaged or Incorrect Items  
If an order arrives damaged or incorrect, the customer must:  
● notify BelgianMart within 48 hours of delivery, and  
● provide clear photographic evidence of the parcel, packaging, and affected items.  
Claims submitted outside this timeframe or without sufficient proof may be refused.  
8. Customs and Import Regulations  
For international shipments, the customer is responsible for complying with all import  
regulations applicable in the destination country.  
If a shipment is refused, seized, blocked, or destroyed by customs or governmental  
authorities, no refund will be issued, provided that BelgianMart has completed all customs  
declarations accurately and in good faith.  
If the parcel is returned to BelgianMart in its original condition, a refund will be issued  
excluding shipping costs, customs duties, taxes, administrative charges, and return  
handling fees.  
9. Right of Withdrawal (EU Consumers Only)  
EU-based customers have the right to withdraw from their purchase within 14 calendar  
days from receipt of the goods, without providing any justification.  
The right of withdrawal may be exercised by:  
● any clear written statement, or  
● use of the standard withdrawal form, available upon request.  
Exceptions  
The right of withdrawal does not apply to:  
● perishable goods (e.g. fresh chocolate, heat-sensitive products),  
● custom-made or personalized items,  
● sealed goods opened after delivery (including beverage bottles),  
● goods returned damaged, incomplete, or without original packaging.  
Returned goods must be unused, unopened, intact, and in original packaging.  
Return shipping costs are borne by the customer.  
10. Legal Warranty  
Products benefit from the applicable Belgian legal conformity warranty, in accordance  
with consumer protection laws.  
11. Limitation of Liability  
BelgianMart’s liability is limited to the total amount paid for the order concerned.  
BelgianMart shall not be liable for:  
● carrier delays,  
● customs delays or losses,  
● indirect damages, loss of profit, resale loss, or commercial impact,  
● force majeure events.  
Nothing in these Terms excludes or limits liability for fraud, gross negligence, or mandatory  
statutory consumer rights.  
12. Personal Data and Cookies  
Personal data is processed in accordance with the General Data Protection Regulation  
(GDPR).  
Details regarding data processing and cookies are available in the Privacy Policy published  
on the Shopify store.  
13. Intellectual Property  
All content available on the BelgianMart Shopify store, including text, images, branding, and  
structure, is protected by intellectual property rights and may not be reproduced or reused  
without prior written consent.  
14. Governing Law and Jurisdiction  
These Terms are governed by Belgian law.  
In the event of a dispute, jurisdiction shall belong to the courts of the seller’s registered  
office, without prejudice to mandatory EU consumer protection rules allowing the  
consumer to bring proceedings before the courts of their country of residence.  
15. Online Dispute Resolution  
In accordance with EU Regulation No. 524/2013, EU consumers may submit disputes via
